Eric Steinert Quoted in Associated Press
"Wave of lawsuits over seats hit retail stores"

Seyfarth Shaw San Francisco partner Eric Steinert was quoted in an Associated Press article on June 18 regarding a recent uptake in lawsuits over "suitable seating" provided by employers to their employees. According to the article, retailers stand to lose millions of dollars in damages now that plaintiffs have two recent appellate decisions and California's "private attorney general" provision in their armory.

"We are really in unchartered waters," he said. "But there's no doubt there's a wave of lawsuits being filed. You are seeing some attorneys moving into this area who previously didn't pay attention to workplace issues."

Based on a provision of the labor code and referring to an order issued by the Industrial Welfare Commission, Eric mentioned that some of the first lawsuits were filed in 2009.
