Fifth Circuit Expands FMLA Coverage

A new decision from the U.S. Court of Appeals for the Fifth Circuit in New Orleans (covering Texas, Louisiana and Mississippi) finds that even employees who are not covered by the FMLA can sue their employers for FMLA violations if their employers mistakenly assure them that they are covered by the FMLA. Minard v. ITC Deltacom Comm. Inc., 5th Cir., No. 04-30230 (4/18/06).
