Howard Wexler Discusses NY Manual Workers Facing New Limits in Pay-Delay Cases in Bloomberg Law and Newsday
Howard Wexler was quoted on new restrictions on pay-delay lawsuits for New York manual workers in both Bloomberg Law and Newsday. Wexler discussed how New York’s newly enacted budget significantly reduces the damages available to manual workers who sue their employers for failing to pay them as frequently as state law requires, although it leaves unresolved whether they can bring these cases at all.
In Bloomberg Law, Wexler said:
“The change dramatically cuts the available damages, which is a big relief for employers, but it’s still a live issue whether there’s a private right of action in the first place.”
In Newsday, Wexler commented:
“The budget may not mean cases go away, but we anticipate much less of them being filed.”
