Ian Morrison Quoted in The American Lawyer
"With Lots of Help from Dukes, Seyfarth Shaw Nixes Class in ERISA Suit Against Motorola"

Seyfarth Shaw Labor & Employment lawyer Ian Morrison was quoted and mentioned in The American Lawyer on November 16. The article discussed an ERISA class action case against Motorola in which Seyfarth attorneys persuaded a Chicago federal district court judge to reject a motion to certify a class of more than 45,000 Motorola employees.

Ian led the Seyfarth team on behalf of Motorola to oppose class certification on the grounds that the plaintiffs did not meet almost every standard for certification under Rules 23(a) and (b). The article states that since June 2011, defendants have cited the U.S. Supreme Court decision in Dukes v. Wal-Mart, which set forth commonality requirements for class certification.

Ian said, "It really does appear to be one of the first ERISA cases applying Dukes in the class context. The judge has really singled out Dukes as the reason for denying cert and emphasized that the claims are really not uniform across the class."
