Jeffrey Berman Quoted in BNA’s Daily Labor Report
“NLRB Notice Proposal Draws Heavy Comment Including Debate About Need, Legal Authority”
Employment partner Jeffrey Berman was quoted in the February 25, 2011 Daily Labor Report discussing the National Labor Relations Board's (NLRB) proposal that requires employers to post a notice informing employees of their rights under the National Labor Relations Act (NLRA). The proposal prompted more than 6,400 public responses to the government’s website http://www.regulations.gov during a comment period that closed February 22. Jeffrey noted that the Department of Labor had agreed that its required NLRA rights posting by federal contractors would not apply to contractors that held themselves out as religious institutions, and were nonprofit religiously affiliated organizations. He further noted that “if the Board proceeds with the notice posting requirement, we urge the Board to specifically provide that religious healthcare institutions are included within the exclusionary language for ‘religiously affiliated employer' so long as they are non-profit, hold themselves out to the public as being religious, and are religiously affiliated.”
