"For our health care clients, we are seeing a significant increase in the number of employees who raise compliance issues and later claim that they were terminated in retaliation for whistleblowing," Casciari told Law360. "Given the complexity of health care regulation, it has become relatively easy for terminated employees to raise these whistleblower-type claims, which are often difficult and expensive to defend."

In this type of environment, Casciari urged caution: "Health care human resources professionals need to review recommendations for employee terminations before they are carried out to make sure the terminations are defensible, internal policies are followed, there is proper documentation and others who have engaged in the same conduct were treated in the same manner.
