“An Operator’s Guide to the Employee 'Forced' Choice Act."
John Toner was quoted in the January 2009 issue of Lodging in the article, "An Operator’s Guide to the Employee 'Forced' Choice Act." The article reported on the possible passage of the Employee Free Choice Act (EFCA) and what it would mean for hotel operators. According the article, if EFCA is signed into law, the lodging industry will face a number of new operational challenges. One challenge would be the loss of the secret ballot election. The bill would also eliminate the need for a union to win an election in order to become an employee’s representative. Jack noted that "Since 1935, employees have enjoyed the right to decide whether or not they want to be unionized by casting ballots in National Labor Relations Board (NLRB) conducted secret ballot elections." He further noted, "Because of the integrity process, knowledgeable labor law practitioners have called the NLRB's secret ballot election process the 'crown jewel' of our nation’s labor practices."
