“How Far is Too Far in Seeking Confidentiality?”
Seyfarth Shaw Labor & Employment partner Kenneth Dolin authored an article published in the September 30 edition of The National Law Journal discussing the business justifications employers may have for asking employees to keep confidentiality for certain information. Ken uses several case examples to illustrate the case-by-case nature of how controversial and varying the rulings on these matters can be, and in order to keep up with the current National Labor Relations Board law, it would be prudent not to prohibit all employee discussions, instead take into account a particular need for confidentiality on an individualized basis.
