Kenneth Sulzer Participated in Q&A with the Daily Journal
Labor and Employment partner Kenneth Sulzer joined a panel of experts from Northern and Southern California on April 1 to discuss new legal issues arising from technology innovations.
Ken responded to a question regarding how social media affects employment law by noting the American Medical Response case that recently settled with the National Labor Relations Board (NLRB). In the case, a company's social media policy caused the NLRB to issue a complaint for an unfair labor practice because an employee's use of social media can be considered "protected concerted activity." The article explained that this case shows the Obama administration and the NLRB understand that unions intend to use social media to reinvigorate the labor movement.
Ken noted, "I see more corporate campaigns. Unions are using wage-and-hour class actions as a part of an organizing effort. On the employer's side companies are using social media during union negotiations to counter claims made by unions."
