“Associate Hire Gets Plaintiffs’ Firm Booted”

Krista Pratt was quoted in the August 11, 2009 issue of The National Law Journal article, “Associate Hire Gets Plaintiffs’ Firm Booted.” The article discussed the recent ruling where a federal magistrate judge disqualified a Boston plaintiffs’ law firm from an overtime case because of a conflict created when it hired a former Seyfarth Shaw associate.

According to the article, U.S. Magistrate Judge Robert Collings granted an emergency motion to disqualify counsel filed by Robert Half International (RHI). Judge Collings ruled that Lichten & Liss-Riordan could not continue representing two former RHI managers in a case alleging that the company violated the Fair Labor Standards Act. The judge determined that the former Seyfarth Shaw associate had material information that was substantial to the case, creating a conflict of interest requiring Licten’s disqualification. Krista, who represents RHI, commented that the court “came to the right decision.”
