Kurt Kappes and Robert Milligan’s article, "Your Company Cannot Afford Not to Adequately Protect Its Trade Secrets and Other Confidential Information," was published in the November 24, 2008 edition of Bloomberg Law Reports, Intellectual Property and the December 1, 2008 edition of Bloomberg Law Reports, Labor and Employment. In their article, Kurt and Robert discuss how the convergence of the country's current downward economic trend and technological advances has lead to an increased need for companies to evaluate their trade secret protections. According to the authors, "many businesses are increasingly relying on intangible or knowledge-based assets. In these economic times, when layoff and mergers abound, the risk of trade secret theft is high." The authors outline the importance for companies to adequately protect their most valuable assets and discuss their solution to the problem. The authors explain that employers will want to ensure that they have effective policies and practices in place to protect their trade secrets, including those involving departing employees. [N.B.
