“Defense of Marriage Act ruling raises employers' discrimination risks”

Seyfarth Shaw Labor & Employment partner Laura Maechtlen is quoted in a July 14 Business Insurance article discussing possible increased exposure to certain types of workplace discrimination and retaliation claims resulting from the Supreme Court’s partial overturn of the Defense of Marriage act. Laura points out one example in which a particular employee could prove they were experiencing discrimination, not because he or she is exhibiting typical behaviors associated with their gender, but because of who they’ve chosen to marry.
