“Revival of BofA Seating Suit a Pain in Butt for Cos.”

Seyfarth Shaw Labor & Employment partner Laura Maechtlen is quoted in a February 15 Law360 article discussing a recent Ninth Circuit ruling over suitable seating for workers in which the panel reversed the dismissal of a case that could have thwarted a current rise in suitable seating litigation.

Laura points out “that the Ninth Circuit decision simply addresses whether the seating request issue is enough to get a case nixed at the motion-to-dismiss stage. But later in a case, an employer might be able to present evidence that workers just don't want seats, for example.”
