Law360 Employment Authority quoted Patrick Bannon and an amicus brief filed by Seyfarth’s Wage and Hour Litigation Practice in their coverage of amicus briefs filed to the Supreme Court in connection with an Eli Lilly age discrimination lawsuit,  “Trade Groups Want Justices To Mull Collective Standard.”

Bannon emphasized the need for the Supreme Court to clarify its Hoffman-La Roche decision, stating “the Supreme Court should review the case to correct a widespread, fundamental misunderstanding of the Supreme Court's Hoffman-La Roche decision.”

“Except in rare circumstances (and the circumstances in Hoffman-La Roche were very unusual), suggesting to nonparties that they might consider filing or joining a lawsuit is not a proper job for a court,” Bannon said. “Nothing in Hoffman-La Roche requires district courts to involve themselves in that, and they generally should not be involved in doing that.”
