"Labor & Employment Regulation To Watch In 2011"

Employment partner Leon Sequeira was quoted in the January 1 edition of Employment Law360. The article reported on the slim chance that Congress will move forward on labor and employment legislation in 2011, but cited that regulatory changes that could potentially pose significant challenges for employers may be on the horizon. According to the article, the Right to Know Under the FLSA will add an amendment in April that will require any business that claims workers that are exempt from FLSA coverage to perform a classification analysis, disclose that analysis to the workers it covers and hold on to the analysis in case Department of Labor personnel request it.  Leon noted that there is no way to know exactly what will be in the proposed rule, but it is worth watching. He further noted that "there is the potential for a very serious impact on private sector employees."
