Leslie Solondz was quoted in BNA's Employment Discrimination Report article, "Consider Attorney-Client Privilege For Self-Evaluations, Consultant Says," published July 21, 2010. The article reported that federal contractors should consider using attorney-client privilege to protect themselves from charges of discrimination by employees and federal regulators. According to Leslie, such a privilege should be considered when conducting pay disparity self-audits, making recommendations for change, or implementing pay adjustments and corrections. She suggested that contractors fix "any hiring and compensation disparities they find when evaluating employee compensation," because such changes could be used as evidence by regulators or employees alleging discrimination." Leslie also recommended that contractors ensure adverse impact and compensation-related compliance efforts are “directed by counsel” and documented as such. She explained that a summary of results by an attorney also helps improve the chances that attorney-client privilege will be upheld if challenged.
