Louisa Johnson and Kerry Friedrichs’ blog post, “Second Circuit Finds Fluctuating Workweek Does Not Require Much Fluctuation” was referenced in a July 6 story from HR Dive, “2nd Cir.: Workers' hours need not drop below 40 for fluctuating workweek pay.” The 2nd Circuit's ruling has several clear takeaways, including that employers must communicate to employees paid by the FWW method how they are compensated, according to Johnson and Friedrichs.
