“In Another Blow to ADA Class Actions, Certification Denied for Wendy’s Employees”

Seyfarth Shaw Labor & Employment partner Lynn Kappelman is quoted in an April 25 HR Compliance eXpert article discussing the difficulty in bringing class action suits invoking the Americans with Disabilities Act, as in a recent case involving Wendy’s employees attempting to sue the fast food chain on behalf of “all persons who have been terminated or separated from employment following a leave of absence and/or otherwise not accommodated by defendant’ failure to transfer to vacant positions.”

Lynn points out “Class actions require commonality and typicality and ADA requires such an individualized review that it’s hard to find a group of people with the same disability and same accommodation needs.”
