Seyfarth Shaw Labor & Employment partner Marshall Babson was quoted in Bloomberg on August 5. The article discussed a growing number of cases involving social media in the workplace and how the National Labor Relations Board has sided on issues regarding employees speaking out online.

While a policy has yet to be adopted on whether employees may discuss the workplace online without consequence, those who have been reprimanded for their posts assert that the 1935 National Labor Relations Act protects them.

"Employees in the old days gathered at the water cooler. Social media is the 21st-century analogue. Employees use this device to air grievances and solicit opinions from employees. That's why it's protected," Marshall said.
