“Congress May Cripple NLRB Post-Liebman, Becker”
New York partner Marshall Babson was quoted by Law360 in an Aug. 26 article about the recent departure of National Labor Relations Board Chairwoman Wilma Liebman and the expiration of Craig Becker's term at the end of 2011.
According to Law360, many see this as a golden opportunity for Republicans in Congress to leave the labor agency without the quorum it needs to issue decisions or promulgate rules.
Babson, a former NLRB member, noted that a two-member board next year was a real possibility. “I think it's unfortunate,” he said. “We appear to be in a time of great partisanship, and that's not a formula for getting things done.”
Babson said shutting down the NLRB would have detrimental consequences for both labor and management. He added that the overwhelming majority of cases the board decides are not controversial.
