"NLRB To Revisit Rules Barring Grad Assistants From Unions"

Seyfarth Shaw Labor & Employment partner Marshall Babson was quoted in Law360 on June 23 in an article about the National Labor Relations Board's review of the dismissal of two union representation petitions for graduate student assistants, which could reverse an earlier decision that declared that grad students could not unionize.

Marshall said he found it regrettable that the NLRB saw the need to tackle the question of graduate assistant status at this time, particularly in light of the controversy that the NLRB's actions have sparked in the past couple years.

He said the issue is straightforward: Aspiring university professors honing their teaching skills are still students because they are learning their craft.

“We have had too many twists and turns, too may flips and flops, for the board to be revisiting this issue now,” he commented.
