“Courts: Landlords can’t sue architects for ADA slips”

Seyfarth Shaw Labor & Employment partner Minh Vu authored an article published in the April 5 edition of the Washington Business Journal discussing a recent trend in decisions holding that property owners cannot sue their architects or consultants for failing to design public accommodations and housing facilities that are accessible to people who are covered under the Americans with Disabilities Act and the Fair Housing Act.

For property owners, Minh suggests a proactive approach, which includes inserting contractual provisions in contracts requiring architects and consultants to comply with ADA and/or FHA requirements and covering owners for losses resulting from noncompliance. She also suggests hiring professionals with experience apply the accessibility standards and requirements.
