Minh Vu Quoted in Acquatics International
"Did Acquatics Really Get a Pass on ADA?"

Seyfarth Shaw Labor & Employment partner and leader of the firm's ADA Title III Specialty Team Minh Vu is quoted in the June edition of Acquatics International. The artice discusses revised standards for swimming pools and spas which make allowances for portable pool lifts.

According to the article, there is still some confusion and concerns about what is meant by "readily achievable" in the documentation. However, according to Minh, no examples or scenarios are provided.

“ ... Is it ever readily achievable for a business in bankruptcy to buy a new lift? If there is not enough pool deck space to comply with lift space requirements, is a lift still considered ‘readily achievable?’  Because there is no guidance and no clear answers, businesses can never be certain that their position that a lift is not readily achievable will prevail if they are sued,”  she added.
