"Congress Takes Aim at ADA Pool Regs"
Seyfarth Shaw Washington, D.C. partner Minh Vu was quoted in an article in the May edition of Aquatics International on the recent U.S. House of Representatives Commerce, Justice, and Science Appropriations Act (CJS). The bill will help prevent the Department of Justice (DOJ) from using funds to implement the Americans with Disabilities Act (ADA) mandate of permanent pool lifts in facilities including municipal pools, and those of hotels and spa facilities.
Minh, who represents the hotel and lodging industry and has served as the American Hotel & Lodging Association’s outside counsel, told Aquatics International that as long as the bills are under consideration, they may help “to dissuade plaintiffs from suing”.
A congressional hearing was held in April, and while DOJ officials decide on the ADA compliance deadline, pool operators are expected to be in compliance by May 21.
