"House of Representatives may remove pool lift installation extension from ADA rules"

Seyfarth Shaw Washington, D.C. partner Minh Vu was quoted in Hotel Management on May 9. The article discussed a recent hearing in which the House of Representatives considered removing the amendment protection for the State Appropriation bill which would make changes related to the Americans with Disabilities Act regarding pool lifts.

"Other options that are available include sloped entries or ramps, but using a pool lift is the only feasible solution for the majority of properties," said Minh. "There are nine requirements that hotels have to comply with, and most of the industry was planning on purchasing portable lifts."

Manufacturers also claim that not enough pool lifts can be produced to meet the current hotel industry demand, resulting in further violations. Minh pointed out, "Hotel owners and operators really do want to comply and provide the lifts. They don't understand why a portable lift isn't as good as a fixed lift. They are also concerned about children playing on the lifts and having catastrophic injuries."
