“DOJ settlement over food allergy sets the table for future actions”

Seyfarth Shaw Labor & Employment partner Minh Vu is quoted in a February 8 Lawyers USA article discussing a recent settlement concerning whether a food allergy constitutes a disability under the Americans with Disabilities Act. The Department of Justice ruled that students suffering from celiac disease in a private university were discriminated against when made to participate in a mandatory dining plan which failed to accommodate their dietary needs. As a result, the university paid affected students and was forced to implement changes regarding dietary accommodations and employee training.

Minh commented, “This is an extremely elaborate settlement, and it is indicative of a very aggressive enforcement posture by the DOJ that we anticipate will be replicated.”
