Noah Finkel Discusses Uncertainty of Future FSLA Settlement Approvals in Law360 Employment Authority

Law360 Employment Authority quoted Noah Finkel in its article, “Courts Grow Dubious Of Approval Obligation For FLSA Deals,” on June 13. Finkel discussed how the future of Fair Labor Standards Act settlement approvals is increasingly uncertain, as federal district court judges have been departing from precedent by saying parties can privately settle without court approval.

“It's a recognition by these courts that parties are represented by sophisticated counsel who are looking out for their clients' best interests and that there's little value in having courts babysit them in that process.”
