“7th Circ. Ruling Raises Bar for FLSA Class Cert”

Seyfarth Shaw Labor & Employment partner Noah Finkel is quoted in a February 8 Law360 article discussing a recent decision upholding decertification of a class of satellite technicians who brought wage-and-hour claims. According to Noah, “It is very significant because there are precious few cases describing just what the standard is on how to evaluate ultimate certification in collective actions….This case, however, indicates that courts should be using a fairly rigorous standard…when deciding whether to ultimately certify a collective action.”
