Discussed Employer Use of Credit Reports in Hiring
Chicago partner Pamela Devata appeared this morning on the Fox Network's "Fox and Friends" news program, discussing employer use of credit reports and credit history in hiring. Supporting the management perspective in a debate format, Pam opposed Maryland House Delegate Kirill Reznik (D), who introduced Maryland House Bill 87 concerning the Job Applicant Fairness Act.
Pam noted the Federal Credit Reporting Act contained provisions requiring consent by the prospective employee, and 87 percent of employers look at a prospective employee's credit report after the interview or a conditional offer is made. Pam also emphasized that credit reports are only one factor in an employer's decision-making process, and they can serve as a useful tool for employers by providing information about a person's fiscal responsibility. This was Pam's second appearance on "Fox & Friends," on this topic, and she presented the facts, helping dispel assumptions about the use of credit reports by employers.
