Paul Kehoe was quoted in an April 16 story from Politico on the recently proposed EEOC regulation which states that employee wellness programs will be deemed ADA-compliant so long as any reward or penalty for participating or not participating doesn’t exceed 30 percent of what the employee would pay to participate in a group health plan. Kehoe discussed one of the unanswered questions from the proposal: how the Genetic Information Nondiscrimination Act should be applied to employee wellness programs — a question that came up in the Honeywell lawsuit.
