Preventing and Managing Workplace Violence: Legal and Strategic Guidelines, a recent book published by the American Bar Association and edited by Mark Lies, is now available. It is a practical guide for those charged with addressing workplace violence concerns either on behalf of their employer or their client. The book defines workplace violence and identifies possible settings where violence may be more likely to occur, how to recognize the signs, and what to do if you suspect an employee is a potential risk. In particular, it sets out the employer's legal obligations and limitations in addressing this risk, including all applicable employment laws. There is guidance on how to conduct "threat assessments" and "fitness for duty" evaluations by selecting a qualified health professional. Finally, there are resources on how to develop a written workplace violence prevention plan, as well as an action plan if it appears that an incident may be imminent.
