“Keeping Tabs On Employee Social Media Discourse”

Seyfarth Shaw Labor & Employment attorney Reema Kapur authored an article published in the May 2 edition of Law 360 in which she discusses the recent SEC guidance and report on corporate disclosures of material, nonpublic information through social media and what it means for employers.  

The SEC report suggests that it may hold a company liable if top management post important company information such as financial metrics on their personal social media accounts particularly where the company has not designated social media as a “recognized channel of distribution.”  She cautions employers to re-examine their social media policies and train employees regarding the consequences of their social media activity.
