Chicago attorney Richard Lapp was quoted January 20, 2011 in Air Cargo World. The article reported on DHL’s successful defense against a labor claim resulting from the breakup of its U.S. domestic shipping division in 2009.

In the case, former employees claimed they were not given sufficient notice prior to the breakup of the division, according to the rules stated in the Work Adjustment and Retraining Notification (WARN) Act. The court ruled in favor of DHL, deciding that WARN did not apply, as employees had voluntarily waived their rights to file suit against DHL in exchange for severance pay.

“For employers, what this does is it gives you guidance … so that if you’re faced with this situation, you don’t just go straight to, OK, we have to go ahead and give notice under WARN,” commented Rich. “Maybe not.”
