"Wage-and-Hour Lawsuits Surge in New York Federal Courts"

Seyfarth Shaw Labor & Employment partner Robert Whitman is quoted in an April 30 New York Law Journal article discussing the increasing trend of lawsuits brought by workers under the Fair Labor Standards Act, which generally claim their employers either did not pay overtime or that the workers were misclassified as exempt from earning overtime wages.

According to Rob, FLSA filings have risen much more quickly in the metro New York area than nationally, and he doesn't see any signs that the litigation will decrease. He also points out that a large percentage of cases are against small businesses, such as delis, grocery stores, beauty salons, car washes and bodegas.
