Sam Schwartz-Fenwick was quoted in a February 17 story “Borzi: Health Nondiscrimination Rule Is ‘Trap for the Unwary'” by Bloomberg BNA on how a 2015 proposed rule on health-care sex discrimination from the Department of Health and Human Services applies to any plan in receipt of federal funds, even a self-funded plan that uses a claims administrator that receives federal funds according to Assistant Labor Secretary Phyllis C. Borzi. In addressing the needs of transgender workers, Schwartz-Fenwick said employers should step back and realize that being transgender is bigger than just a surgery.
