Sam Schwartz-Fenwick Quoted Extensively in Law360 on 11th Circuit’s Skrmetti Ruling

Law360 quoted Sam Schwartz-Fenwick extensively in its article, “En Banc 11th Circ. Ruling Hints At Broad Reach For Skrmetti,” published on September 10. Schwartz-Fenwick provided analysis on the potential impacts of this decision on company benefit packages.

“Nothing in this decision requires an employer to cut back on its benefit offerings. That said, the court in the Eleventh Circuit said that exclusions based on coverages for gender dysphoria don't violate Title VII. Before an employer goes ahead, though, and reinstitutes, or institutes, an exclusion like that, they should work really closely with counsel because there might be other federal laws to consider for a risk analysis. In addition, certain health plans are also subject to state insurance regulations.”
