International Employment Lawyer quoted partner Sam Schwartz-Fenwick in its article, “Workers Doxed, Cancelled for Posts Condoning Charlie Kirk’s Death,” published on September 15. Schwartz-Fenwick explained that, while private employers generally have broad discretion to discipline employees for off-duty speech that causes reputational harm, they should ensure policies are clearly worded, legally compliant, and mindful of state-specific protections.

“The overwhelming majority of individuals in the United States are at-will employees. This gives private employers significant leverage in terms of defining what is and what is not an action that could give rise to discipline,”
