Seyfarth Shaw's 2009 Workplace Class Action Litigation Report was featured in the Chicago Daily Law Bulletin article, "Worker; Retiree Class Action Surge: Report,” published January 29, 2009. The article discussed how, according to the report, class-action litigation over workplace retirement plans surged in 2008 in filings and settlements as workers struggled to recoup 401(k) losses and retirees fought to protect benefits. Additionally, according to Gerald Maatman, the report's general editor, employees are suing for alleged breaches of fiduciary duty to try to recover 401(k) losses in the financial meltdown. The report also noted that "more than any other area of workplace litigation, ERISA class action took center stage in 2008 and the current wave of Employee Retirement Income Security Act (ERISA) class actions has not yet crested." The article noted that the report analyzes the leading class action and collective action decisions in 2008 involving claims against employers under Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act, FLSA and ERISA. The report also analyzes class action and collective action rulings involving claims brought against employers in all 50 state court systems.
