SHRM Quotes Pamela Devata on New York’s Credit Check Ban

SHRM quoted Pamela Devata, partner in Seyfarth’s Labor & Employment department, in its April 17, 2026 article, “New York Bans Credit Checks in Employment Decisions.” The piece examines New York’s new statewide prohibition on using credit history in most employment decisions and the compliance implications for employers and background screening providers. 

Devata highlighted that the law also places new limits on consumer reporting agencies, noting:

“A consumer reporting agency may not provide a consumer report containing credit-history information for employment purposes unless a statutory exemption applies. This requirement mirrors the employer-side prohibition and prevents background providers from supplying credit information where employers may not lawfully use it.”
