"Banking Kin Care: Employer Kin Care Leave Obligations Arise Only When Policies Provide Accrual-Based Sick Leave"
Los Angeles attorney Simon Yang's article, "Banking Kin Care: Employer Kin Care Leave Obligations Arise Only When Policies Provide Accrual-Based Sick Leave," was published in the Fall 2010 issue of Employee Relations Law Journal. The article discusses the California "kin care" statute, which requires that employees entitled to accrued sick leave be allowed to use some of it to care for ill relatives, and a recent decision by the California Supreme Court, which ruled that the statute does not apply to all forms of compensated time off for illness, but only to "sick leave" as defined by the statute. West Coast attorneys David Kadue, Alfred Sanderson, and Joshua Rodine assisted in the preparation of this article.
