Texas Pauses Pending Data Center Grid Interconnections for Project-by-Project Audit

In May, we wrote that ERCOT was moving toward a more selective, maturity-driven framework for large-load interconnections and that interconnection readiness was becoming a gating issue for Texas projects. Texas has now moved another step in that direction.
On August 3, Governor Greg Abbott directed the Public Utility Commission of Texas (“PUCT”) and the Electric Reliability Council of Texas (“ERCOT”) to conduct a comprehensive verification and audit of data centers advancing through ERCOT’s interconnection process. On August 6, the Governor’s office described the directive as a pause on all pending data center interconnection requests until each project successfully completes the audit.
What Changed
Texas is responding to an extraordinary volume of proposed large-load development. According to the Governor’s office, ERCOT is considering more than 474 GW of proposed load, more than five times ERCOT’s record peak demand, with data centers representing approximately 90 percent of those requests.
The State’s audit will require project-level information concerning:
- projected electricity demand and plans for on-site generation or other measures to reduce reliance on the ERCOT grid;
- projected water use, water sources, reuse strategies, and cooling technologies;
- state and local incentives and other public financial assistance;
- measures to reduce impacts on neighboring properties and communities; and
- project ownership and controlling interests.
Projects that fail to comply with the audit requirements may be denied interconnection to the ERCOT grid. The Governor’s office announced on August 6 that QTS Data Centers had agreed to participate in the audit and comply with the State’s standards.
What This Means Right Now
The immediate issue for projects seeking new ERCOT grid capacity is timing.
ERCOT implemented its new “Batch Zero” large-load interconnection process in July and previously established August 7 as the deadline to notify transmission and distribution service providers of initial project classifications. At the time of publication, neither ERCOT nor the PUCT had publicly announced a change to that deadline. ERCOT’s most recent relevant Market Notice stated that it would continue to process and classify large loads according to the existing Batch Zero timelines.
The Governor’s directive nevertheless creates uncertainty regarding what happens next for affected data center projects. ERCOT could issue classifications while limiting subsequent advancement until the applicable audit is complete, or the State could provide additional direction regarding the Batch Zero process. Importantly, the directive is not a moratorium on data center development in Texas. It targets pending requests to interconnect data centers to the ERCOT grid. Projects may continue to advance development activities while the audit is underway, although projects dependent on new grid-supplied capacity may face uncertainty regarding the timing of interconnection and energization.
Support Is Now Even More Important
Projects should be prepared to substantiate more than a requested load and a place in the interconnection process. Site control, capital commitment, customer demand, realistic load assumptions, development progress, infrastructure planning, and a credible power strategy may all become increasingly important indicators of whether a project is positioned to advance.
There may ultimately be a benefit for mature projects if the audit removes duplicative or non-executable load requests from ERCOT’s pipeline. With requested load many times larger than actual ERCOT system demand, a more accurate picture of viable projects could improve long-term transmission and infrastructure planning. In the near term, however, the result is additional process uncertainty.
What Market Participants Should Do Now
A delay in the ERCOT process will not necessarily excuse performance under a purchase agreement, lease, development agreement, joint venture, financing arrangement, or customer contract. Accordingly, parties developing, financing, investing in, or contracting with Texas data center projects should:
- review transaction documents for outside dates, extension rights, conditions precedent, regulatory-delay provisions, force majeure, termination rights, and other provisions tied directly or indirectly to power availability;
- confirm where each project currently sits in the ERCOT and utility interconnection process;
- prepare to substantiate project maturity and the information requested through the State’s audit;
- stress-test development and energization schedules for additional interconnection delay; and
- evaluate dedicated generation, behind-the-meter, and similar hybrid power strategies.
Bottom Line
Texas is applying greater scrutiny to data center projects seeking access to the ERCOT grid, but the new directive is not a moratorium on data center development. For developers, hyperscalers, investors, lenders, landowners, and energy companies, the development implications will depend significantly on a project’s reliance on new grid-supplied capacity. The added uncertainty also increases the strategic value of dedicated generation, behind-the-meter, and hybrid power solutions that can reduce dependence on the traditional grid interconnection process. Projects seeking ERCOT grid capacity should be prepared to demonstrate that they are real, ready, and adequately supported.
