In this webinar recording, Seyfarth class action lawyers and the Illinois Chamber of Commerce offer an important BIPA litigation and legislative update, including protective measures companies can take to reduce BIPA exposure in the era of COVID-19. Learn about key litigation developments under BIPA and the Illinois legislative fixes that have been proposed as well as how you can help in that important effort. This legislative effort is a unique opportunity to permanently improve the law with a lasting, far-reaching impact as distinguished from case-by-case litigation. Topics covered include:

  • BIPA’s potential application to temperature-taking and other measures being taken by employers returning employees to work in the era of COVID-19;  
  • Key defenses businesses are relying upon to try to defeat BIPA claims altogether, including arguments that the claims are preempted by the Labor Management Relations Act, the National Labor Relations Act, and the Illinois Workers’ Compensation Act, among other defenses.
  • Procedural issues regarding whether these cases will be heard in federal or state court.
  • Ambiguities in the statute that are being exploited by the plaintiffs’ bar, including regarding the applicable statute of limitations, the calculation of damages, and attorneys’ fees.
  • A legislative update regarding important BIPA amendments (HB5374, SB3776) that through the efforts of the Illinois Chamber, assisted by Seyfarth, have been introduced by key members of both chambers of the Illinois Legislature.  Learn what you can do to assist in the passage of these important amendments and how they may impact current and future litigation under BIPA.
