About the Program

Under the Massachusetts Personnel Record Statute, employers have duties and rights when it comes to maintenance and disclosure of employee personnel records. The Statute dictates what is and is not a “personnel record”, how long a personnel record must be retained, who may access a personnel record, what should occur when there is a dispute between an employer and an employee about the content of an employee’s personnel record, and the consequences of non-compliance. The Statute is not crystal clear in each of these areas, making navigation difficult for many well-intentioned employers. Also, in a recent decision, Meehan v. Med. Info. Tech., the Massachusetts Supreme Judicial Court opened the door to wrongful termination claims against employers relating to the Statute.
