Three Ways Courts Should Improve FLSA Collective Actions

Some lawyers, litigants and judges may believe that current practices for litigating and managing Fair Labor Standards Act collective actions leave no room for improvement. We disagree. In this article, we argue that the usual path of an FLSA case, though well-worn, is not required by statute or case law. We propose three reforms that, we contend, would often lead to greater fairness and efficiency. Click here to read the article in full on Law360.
