“New DOL Affirmative Action Rules May Ensnare Contractors”

Seyfarth Shaw Labor & Employment attorneys Valerie Hoffman and Christine Hendrickson are quoted in a September 4 Law360  article discussing new affirmative action rules for federal contractors, which are designed to increase hiring of veterans and the disabled. However, Val points out that the disability rule “creates the risk of raising false alarms in the Office of Federal Contract Compliance Programs (OFCCP) audits.”

Christine adds, “Affirmative action and inclusion programs have great benefits for employers and having a more diverse workforce creates a more innovative, more dynamic, more successful company. What gives me great pause about these regulations, however, is that many of the provisions seem to bear little relationship to advancing employment for individuals with disabilities or veterans, but seem more targeted to making the OFCCP’s enforcement duties easier.”
