William Schurgin was quoted in the October 2008 issue of Inside Counsel in the article, "Sex Ruling Could Trigger Flood of Disability Claims." The article reported on the July Adams v. Rice decision that "sexual relations" qualifies as a major life activity for determining whether an individual is disabled under the Rehabilitation Act of 1973, which governs disabled federal employees. According to Bill, “This is very troublesome.”  He explained that the decision suggests an employer should anticipate that an employee could claim an impairment had become a disability long after an employment decision is made. He noted, “Even if the employer had no reason to believe that [the impairment would develop into a disability], the employer could be held liable.”
