Lawrence Lorber was quoted in a January 3 story from Bloomberg Law, "Rumored Nix of Unintentional Bias Theory Unlikely to Affect EEOC." Justice Department officials are said to be mulling over rescinding or rewording regulations on disparate impact—a theory that says neutrally applied practices can nevertheless be discriminatory if statistics show they unfairly affect people based on race, sex, or other protected characteristics. Lorber said that a change in DOJ policy could also cause more confusion, and even be struck down by state law.
