Employers who source talent globally struggle to ensure that the foreign national talent they recruit is available when promised, delivered within budget, and arrives with a positive experience. Employers who overcome these challenges benefit their organizations and enjoy a competitive advantage in recruiting from the global talent pool.

Our Immigration group presents a powerful combination of legal knowledge and business capabilities, providing best-in-class legal services and portfolio management programs for a wide variety of US and global corporations. Working with clients that employ as many as 8,000 foreign nationals has allowed us to develop a robust infrastructure for large program management and the required experience to resolve nuanced immigration challenges that arise for companies with global mobility needs.

Our Immigration team has more than 180 members located across Atlanta, Boston, Houston, New York, Los Angeles, DC, Hong Kong, and Europe, giving us a unique and large platform for helping our clients strategically plan workforces and leverage global talent.

We help our clients with:

  • Hiring employees on H, L, E, O, TN and J nonimmigrant (or temporary) visas, while later considering those employees for immigrant visa (or green card) sponsorship
  • Employment- and family-based options, including Labor Certification, EB-1, EB-2, and EB-3 Employment-based Immigrant Visas (I-140s)
  • Family-based Immigrant Visas (I-130s)
  • Applications for Adjustment of Status (I-485s), which offer the benefit of applying for the Advance Parole (I-131) and Employment Authorization Document (I-765) more commonly referred to as AP/EAD
  • Advice and counsel with regards to Canadian business immigration and various services ranging from securing work permits to permanent residency status
  • Assisting and advising clients on a broad range of UK immigration services which include Intra-Company Transfers, entry clearance visa applications, Sponsor License applications and others

General Global Outbound Services

Led by our in-house global attorney, our Global team is poised to assist our clients’ global mobility needs regardless of the destination. We offer significant and centralized in-house knowledge and insight into the practical aspects of obtaining work permits and entry documents for foreign country assignments. In terms of substantive experience preparing and filing the actual global case, we utilize (in addition to our in-house capabilities) several extensive networks of immigration specialists in foreign countries. This networking model gives us the flexibility to work with the top immigration experts in most foreign countries.

Additionally, our business immigration portfolio management program positions global employers to meet challenges head on by offering the collective experiences of more than 40 full-time immigration attorneys working collaboratively to define best practices for a given immigration challenge; and our long-standing dedication to innovation and process rigor in the immigration space.

Should a matter result in litigation, Seyfarth is uniquely positioned to handle the most challenging business immigration litigation cases. Led by Angelo Paparelli, a well-known business immigration lawyer with decades of experience, and Leon Rodriguez, a former federal prosecutor and Director of US Citizenship and Immigration Services, the team is experienced with mandamus, Administrative Procedure Act, and declaratory judgment cases. This team is unlike any other, combining skilled litigation capabilities, deep immigration knowledge, and extensive government contacts.

Our Immigration team offers a client experience like no other. We function as an integrated national organization, with day-to-day interaction, a shared technology infrastructure, and engagement among attorneys in all the firm’s offices and departments. Our collaborative culture and national platform offer clients cost efficiencies for small issues as they arise, while providing high-level strategic guidance on complex and sophisticated immigration issues at the same time.

We also understand that our clients need to be able to "tell the immigration story" to executive-level stakeholders in meaningful and compelling ways. Our team of data analysts identify trends and uncover insights revealed in the immigration program data and visualize those findings in accessible and impactful ways. We create novel mechanisms to eliminate pain points otherwise experienced in the business immigration world. For example, we offer clients with certain volume levels a case review and signing option that is much less cumbersome and time-consuming than the traditional method. We have also developed professional training videos that convey the required content in a palatable manner more easily consumed by the foreign national employee and manager.

Given that we routinely leverage our collective experience and capture and manage the resulting knowledge via our document assembly platform, it was second nature for us to begin front-loading our immigration benefit requests with case documents and legal arguments intended to preempt (or at least reduce the scope and severity of) the requests for additional evidence (RFEs) that the government is now routinely issuing in the overwhelming majority of cases. Our data confirms the drop-off in number and severity of RFEs issued, with resulting dollar and time savings for our clients.
