Just over two years into the Trump Administration, the U.S. Department of Labor’s Wage & Hour Division (WHD) appears to have hit its stride.  WHD has released more proposed rulemakings over the past several weeks than it had in the preceding two years.  And it has done so by tackling big issues such as the salary threshold required for the white collar exemptions, the proper calculation of overtime rates, and joint employment.

Join members of Seyfarth’s Wage and Hour Litigation Practice Group as they share:
The new, new proposed salary threshold, a proposed increase of nearly 50% in the highly compensated employee threshold, and the anticipated impact on employers.

How WHD is hoping to increase the types of benefits employers can provide to non-exempt employees without causing issues related to the calculation of the overtime rate of pay.

If and when franchisors and staffing company clients may be joint employers under WHD’s latest proposal.
In addition, our team will identify opportunities to provide input on the regulatory proposals and discuss what happens next in the regulatory process.
