Jay advises and counsels owners, developers, project executives and managers, contractors, design professionals, sureties, and insurers. He has in-depth experience assisting them during all phases of a project’s development, construction, and close-out.

Jay has drafted and negotiated hundreds of construction, design, and construction-management agreements. He uses his experience to craft contract provisions that address each project’s unique risks while furthering his clients’ objectives. He regularly works with all types of owner-contractor, contractor-subcontractor, owner-designer agreements, and specialty delivery methods, such as turnkey, design-build, and Integrated Project Delivery.

Jay works with his clients to develop, implement, and oversee risk management and prelitigation strategies, including contract compliance, project documentation, construction operations, claims avoidance, change management, and the preparation of change order requests and claims. He frequently assists his clients with their postcompletion dispute resolution efforts in mediation, arbitration, and at trial.

Jay has experience with a variety of projects, including high-rise office towers, health care facilities, highway design and construction, shopping centers, hotels, residential developments, rapid-transit rail and station projects, as well as solar, wind, and fossil fuel power plants throughout the United States. He was project counsel for the joint ventures that constructed the Bay Area Rapid Transit Authority’s Oakland International Airport Connector and the California Department of Transportation’s Presidio Parkway/Doyle Drive Project, which was California’s first public-private partnership project.
